Terms of Use (EULA)

1. Introduction & Acknowledgement

These Terms & Conditions ("Terms" or "EULA") govern your use of Forged AI, an iOS application (the "Licensed Application") that uses AI to analyze facial features and provide personalized appearance recommendations. You acknowledge that this EULA is concluded between you and Forged AI only, and not with Apple, and that Forged AI, not Apple, is solely responsible for the Licensed Application and its content. By downloading, installing, or using Forged AI, you agree to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you confirm you have permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

3. Scope of License

Forged AI grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the Licensed Application on any Apple device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application, and you may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law).

4. Description of Service

Forged AI operates as follows:

1. The app accesses your device camera to capture a photo upon your explicit action.
2. Your photo is securely transmitted to Forged AI’s own servers, where facial features are extracted. The original photo is permanently deleted from our servers immediately after extraction.
3. Extracted facial feature data and your questionnaire responses are sent to OpenAI’s API to generate personalized analysis, style recommendations, and a glow-up plan. Your photo is never shared with OpenAI.
4. Analysis results are returned to and stored only on your device. Facial feature data is not retained on our servers.

Results are generated automatically by AI and may vary in quality and accuracy. They are intended for personal, informational use only.

5. Camera and Photo Consent

By using the analysis feature, you explicitly consent to the app accessing your device camera and transmitting the captured photo to Forged AI’s servers for facial feature extraction. You confirm that you are the subject of the photo or have the legal right to submit it for this purpose. You may revoke camera access at any time through your device settings, though this will prevent use of the analysis feature.

6. No Medical or Professional Advice

Forged AI is provided for informational and entertainment purposes only. The Service does not provide medical, dermatological, psychological, legal, or professional advice. Always consult a qualified professional for any health or medical concerns.

7. User Responsibilities

You agree not to upload illegal, harmful, abusive, sexually explicit, or infringing content. You must only submit photos of yourself or content you own or have explicit permission to use. Submitting photos of other individuals without their consent is strictly prohibited. You are responsible for all activity performed through your device.

8. Third-Party AI Processing

Forged AI uses OpenAI’s API to process facial feature data and generate recommendations. By using the Service, you acknowledge that de-identified facial feature data and your questionnaire responses will be processed by OpenAI in accordance with OpenAI’s Privacy Policy. Your raw photo is never shared with OpenAI or any other third party.

9. Subscriptions, Billing & Auto-Renewal

Forged AI offers auto-renewable subscriptions that unlock premium features. All purchases and subscriptions are sold and processed by Apple through your Apple ID and are subject to Apple’s Apple Media Services Terms and Conditions.

• Payment: The price and billing period of each subscription are displayed in the app prior to purchase. Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: Your subscription automatically renews for the same period and at the same price (unless otherwise disclosed) unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Price changes: If the subscription price changes, Apple will notify you and ask for your consent before the change takes effect, in accordance with Apple’s requirements.
• Free trials and introductory offers: Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

10. Cancellation Policy

You can manage or cancel your subscription at any time through your Apple ID account settings on your device: Settings > [your name] > Subscriptions. Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until that period ends. Forged AI cannot cancel an Apple subscription on your behalf; cancellation must be performed through your Apple ID.

To avoid being charged for the next billing period, you must cancel at least 24 hours before the current period ends.

11. Refund Policy

All purchases made through the App Store are handled by Apple, and all refund requests are subject to Apple’s refund policy. Forged AI does not process payments directly and therefore cannot issue refunds for App Store purchases.

To request a refund, please submit a request directly to Apple at reportaproblem.apple.com. Apple’s decision regarding any refund request is final. For details, please review Apple’s official refund guidelines.

12. Consent to Use of Data

You agree that Forged AI may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the Licensed Application. Forged AI may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

13. Intellectual Property

The Service, including software, branding, and design, is owned by Forged AI or its licensors and protected by applicable intellectual property laws. You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, Forged AI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim to the extent required by this EULA.

14. Product Claims & Warranty

Forged AI, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application’s use of the HealthKit and HomeKit frameworks if applicable.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Forged AI’s sole responsibility.

15. Limitation of Liability

To the maximum extent permitted by law, Forged AI is not liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, profits, or reputation resulting from your use of the Service. Your use of the Service is at your own risk.

16. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Termination

We may suspend or terminate your access at any time if you violate these Terms or misuse the Service. You may stop using the Service at any time. Termination does not entitle you to a refund except as required by Apple’s refund policy or applicable law.

18. Third-Party Beneficiary (Apple)

You and Forged AI acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

19. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted. Continued use of the Service after updates means you accept the revised Terms.

20. Governing Law & Contact

Except to the extent expressly provided in the following paragraph, this Agreement and the relationship between you and Forged AI shall be governed by the laws applicable to your place of residence, without regard to its conflict of law provisions.
